FAI court process begins for Edinburgh prisoner

The Crown Office has lodged a first notice to begin the court process for a fatal accident inquiry into the death of 57-year-old Stuart Drury.

The 57-year-old, a prisoner within HMP Edinburgh, died on 3 August 2023.

Mr Drury was in legal custody and in the care of the state at the time of his death.

The Crown Office is obliged to investigate such deaths and an FAI is mandatory. A preliminary hearing will be held on 24 November 2026.

The FAI will be heard on 3 December 2026 at Edinburgh Sheriff Court.

Procurator fiscal Andy Shanks, who leads on fatalities investigations, said: “The lord advocate considers that the death of Stuart Drury occurred while in legal custody and as such a Fatal Accident Inquiry is mandatory.

“The lodging of the first notice enables FAI proceedings to commence under the direction of the sheriff.”
