FAI court process begins for Inverness prisoner death

A fatal accident inquiry (FAI) is to take place into the death of a 72-year-old prisoner in HMP Inverness in 2024.

The Crown Office and Procurator Fiscal Service (COPFS) has lodged a first notice to begin the court process for an FAI into the death of John Calderwood Gallagher.

Mr Gallagher, who died in hospital on 2 February 2024, was in legal custody and in the care of the state at the time of his death.

A preliminary hearing will be held on 27 April 2026 before the FAI will be heard on 12 May 2026 at Inverness Sheriff Court. 

Lorraine Almond of the COPFS, Scotland’s death investigation authority, said: “The lord advocate considers that the death of John Calderwood Gallagher occurred whilst he was in legal custody and as such a fatal accident inquiry is mandatory.

“The lodging of the first notice enables FAI proceedings to commence under the direction of the Sheriff.”
