United Airlines has been forced to defend its claim that a “window seat” does not necessarily need to have a window after a judge rejected its attempt to dismiss a passenger lawsuit.
The airline argued that the term referred only to a seat’s position next to the cabin wall, rather than a guarantee of a view outside.
But US District Judge James Donato rejected United’s bid to throw out the case, saying the airline’s own ticketing terms and booking screens indicated that passengers paying for window seats would receive them.
The proposed class action, also brought against Delta Air Lines, was filed after passengers discovered they had been assigned seats beside blank walls on Boeing 737, Boeing 757 and Airbus A321 aircraft.
The passengers claim the airlines failed to disclose the missing windows during booking and are seeking millions in damages.
