Financial Guardians
Renfrewshire Council is seeking to compile a directory of suitable providers in order to facilitate the appointment of Financial Guardians to act on behalf of adults with incapacity. The Council is seeking expressions of interest from enrolled solicitors with sufficient relevant experience to act as financial guardians on behalf of adults with incapacity identified by the Council as requiring such support, where no other suitable individual is forthcoming. Those included in the directory may be nominated by the Council in an application to the Sheriff, who may at his or her absolute discretion decide to appoint the solicitor to perform the tasks and duties outlined in the application.
Any expenses incurred by a financial guardian in normal circumstances will be paid from the estate of the adult on whose behalf the application has been made, at the rates identified by the Office of the Public Guardian and under its supervision. In exceptional circumstances, where an adult’s estate is insufficient to afford proper remuneration, the Council may make supplementary payment towards the expenses of work completed, at its sole discretion.
The inclusion of solicitors in the directory is anticipated to be for an initial period of 3 years with the option to extend for up to a further 2 years on an annual basis at the discretion of the Council.
Expressions of Interest should be in respect of individuals (not partnerships or other incorporated organisations) and should be directed to Maria Sharkey, Lead Solicitor by e-mail at: maria.sharkey@renfrewshire.gov.uk, no later than 2 October 2026. Inclusion will be based on the personal qualities, experience and ability of the solicitor. Following the closing date, those expressing interest will be contacted to supply evidence of their suitability.
