Debates surrounding the creation of the new Arbitration Act 2025 (England & Wales and Northern Ireland) included discussion on preventing fraud and corruption in arbitration. While no fraud-focused amendments made it into the final Act, such discussions have reiterated that fraud and corruption are an important concern for arbitration in all jurisdictions.

Gillian Carmichael Lemaire, Arbitrator & Mediator, and Chair of the Scottish Arbitration Centre, will explore fraud in Scottish arbitration, drawing on British case law and the ICC Commission on Arbitration and ADR’s Red Flag Indicators of Corruption in International Arbitration report. The session will will also consider whether our current legislation addresses the prevention of fraud and corruption in arbitrations in Scotland.
