Greg Cunningham has successfully defended a case that involved multiple claims of sex and disability discrimination.
Sandever v Chief Constable of the Police Service of Scotland involved claims against several individuals and going back to 2017. After 15 days of evidence and written submissions all claims were dismissed.
The case does not involve any novel points of law, but it does serve as a useful reminder for practitioners that, when evidence in chief is provided by a written witness statement, the statement should include all relevant evidence that a party intends to rely on to support the claim.
From a respondent’s point of view, the evidence for any argument on time bar must be set up with relevant and focused cross examination.
