Success for Douglas Armstrong QC in Housing Land Supply Appeal

The challenge to the Inverclyde Local Development Plan by five leading house builders and developers has been successful.
In MacTaggart and Mickel Homes Limited and Others v Inverclyde Council and Another [2020] CSIH 44, the Inner House of the Court of Session quashed the housing chapter of the Inverclyde Local Development Plan.
In accepting the submissions of Douglas Armstrong QC, the Lord President, Lord Carloway concluded that the examination report contained a number of material errors and illegitimately altered the housing land requirement.
