DWF's Scottish projects team advises on West Midlands Metro contract

DWF’s Scottish projects team has advised West Midlands Combined Authority (“WMCA”) on the insourcing of the operation of the West Midlands Metro to wholly owned subsidiary, Midland Metro Limited.

Working closely with WMCA’s in house legal team, DWF advised on the public service contract entered into between WMCA and Midland Metro Limited and the close out of the concession agreement with the outgoing operator, National Express. The concession was terminated on 24 June 2018 when Midland Metro Limited assumed operation of the network.

DWF Glasgow partner Martin Gallaher and solicitor Caroline Tait advised on the transaction with support from partner Suzanne Moir.

The insourcing is part of WMCA’s strategy to significantly expand the existing West Midlands Metro network and thereby maximise the opportunities presented by the planned HS2.

The move will allow WMCA to invest future profits into the network, while providing the flexibility and adaptability required for expansion.
