A woman who was ordered by a court to stop making “loud sex noises” has been jailed after she breached the order.
Gemma Wale, from Birmingham, was handed a two-week sentence after a judge determined she had breached the order by “screaming and shouting whilst having sex” – thereby annoying her neighbour.
Judge Emma Kelly, sitting at Birmingham County Court, said Ms Hale had broken her ASBO.
The judge explained that Birmingham City Council took action following complaints from the neighbour.
Ms Wale’s anti-social behaviour order also prevented her from making banging noises, stamping, slamming doors, shouting and swearing.
The judge said she had breached the order by swearing at a neighbour, fighting with her boyfriend “running around in the property” and “banging around the house”.
Ms Wale lives in a property owned by the council. An earlier hearing heard evidence from a housing officer as well as one of Ms Wale’s neighbours.
The neighbour said Ms Wale’s woke up at about 5am on January 29 whereupon she “started screaming and shouting whilst having sex, which woke us up.”
The judge said: “I am satisfied that during the course of the early hours of 29th January 2015, at around 5am, the defendant was guilty of screaming and shouting whilst having sex at a level of noise which caused nuisance or annoyance to (a neighbour).”
