A lawsuit concerning a woman who was struck in the face by a bird while riding a rollercoaster turns on whether the bird was a duck or a snowy egret.

Hillary Martin is seeking $500,000 in damages from SeaWorld after she says she was knocked unconscious while riding the Mako rollercoaster at the Florida theme park.

Her lawyer, John Morgan, alleges that SeaWorld “dangerously positioned a high-speed coaster over a man-made lake teeming with birds”.

SeaWorld, however, denies that the bird in question was a duck from its lake, arguing that it was instead a snowy egret – a migratory wild bird, FOX 35 Orlando reports.

A collision with a snowy egret “could have occurred regardless of the presence of any body of water within the park”, it says in a new filing.

The company argues that it cannot be held responsible for “a wild animal’s actions”.

A hearing on SeaWorld’s bid to dismiss the case is set to take place on Monday.
