An Introduction to Alternative Dispute Resolution

There is increasing emphasis on diverting disputes from the court process.
Going forward, the Scottish Government has committed to encouraging people to resolve disputes outside court.
This 3 hour virtual classroom explores the various methods of solving a legal dispute without litigating, and to what extent ADR is provided for within the Scottish legal system.
Delegates attending this virtual classroom will:

• examine the key elements of negotiation, mediation, arbitration, adjudication
• look at the Arbitration (Scotland) Act 2010 and Mediation (Scotland) Bill
• consider how ADR fits within the Scottish legal system
• explore ADR in the context of civil litigation and look at what the procedural rules say.

Tutor: Denise Smith has over 13 years of civil litigation experience, including managing a busy Sheriff Court practice and working as an Associate in a top-tier Family Law Team. Since 2014, she has served as a fee-paid UK Tribunal Judge and became a Legal Convenor of the First Tier Tribunal for Scotland in 2020. In 2022, her remit expanded to the Scottish Local Taxation Chamber. Denise holds a Post Graduate Certificate in Mediation and Conflict Resolution and has over a decade of experience delivering TCPD for CLT.
