Scottish EU law expert warns of risks of conflict between Scottish and UK Parliament on Brexit bills

One of Scotland’s leading experts on EU law, top QC Kenneth Campbell has warned of the consequences of the separate legislation currently being promoted by the UK and Scottish governments on post Brexit arrangements.

He warned: “Competing legislation from the Scottish and UK Parliaments about the status of EU law in a post-Brexit Scotland is likely to lead to uncertainty and confusion, and leaves open the possibility of inconsistent provisions. The task of the courts in untangling these will be complicated by the lack of clear guidance in the current draft Bills.”

Mr Campbell will be speaking on the issue at a major “Brexit Update” seminar to be held in Edinburgh on the morning of Monday 26 March. The seminar brings together six of the top experts on the impact of Brexit on Scottish law and legislation.

Other speakers will be looking at how withdrawal from the EU will affect family law (solicitor Rachael Kelsey), consumer law (James Mure QC), trade and customs (Peter Sellar, secretary of the Advocates’ EU law group), and the environment (Stirling University academic Annalisa Savaresi). In addition, Kirsty Hughes, director of the Scottish Centre on European Relations will analyse the current state of the UK-EU negotiations.
