Perth man sentenced for illegally depositing 30 tonnes of waste including asbestos

A 41-year-old man has been ordered to carry out 200 hours of unpaid work under a community payback order for illegally storing waste at a site in Perthshire.

Alistair Roy admitted the offences at Perth Sheriff Court on 6 December 2016.

The court heard that Mr Roy had kept, and allowed the illegal depositing of, approximately 30 tonnes of waste which included sheets of asbestos on the Winter Park site in Blairgowrie between May 2014 and February 2016.

He had also burned a large quantity of mixed wastes, including fridges and freezers, between April and May 2015.

As a result of the waste on the half hectare site, some waste entered the watercourse via the Lunan Burn and Lunan Loch and into the River Tay. This specific area has been designated a “Site of Special Scientific Interest”.

Mr Roy is the subject of proceeds of crime action, which will seek to remove the profits of his criminal activity.

Laura Buchan, assistant procurator fiscal, specialist casework said: “A waste licence application is substantial. It involves a rigorous application process.

“A licence would never have been granted for the waste deposits in this case. The keeping of waste in this way is wholly illegal.

“Businesses avoided paying for proper disposal of their waste by taking it to Alistair Roy’s site and dumping it there. They avoided legitimate disposal costs and that allowed them to undercut rival operators and Roy profited from that arrangement.”
